Vacation Rental Policies and Terms

Birdie 18 Guesthouse at Eagle Crest Resort Location - Redmond, Oregon. We sincerely wish you a memorable vacation and we want you to be our guest many times in the future. So, in order to avoid any misunderstandings, we want the conditions of this rental to be very clear. That way, there will not be any hard-feelings if something comes up.

Please observe all RESORT RULES. We have been informed that the Resort Management has hired a company to enforce their rules and they are empowered to issue citations. Some of the rules include: speed limits, no skateboarding or rollerblading in parking lots, and no parking of RV’s or boats except in RV parking lot or Sports Center parking lot.

CHECK-IN TIME IS AFTER 4 P.M. AND CHECK-OUT IS 11 A.M. Sorry, NO Early Check-ins or Late Check-outs unless previously arranged for a $50 fee. The unit must be cleaned for newly arriving guests. If housekeeping is delayed because you do not check-out by 11am, a charge of $50 for the first hour and $100 for each additional hour delay will be deducted from your security deposit.

This is a NON SMOKING guesthouse for the comfort of ALL our guests. If you must smoke, please use the outside deck or grounds, be conscious of fire danger, and dispose properly of any waste. If you smoke or allow anyone to smoke inside the premises, you will lose your security deposit at a minimum.

PETS ARE NOT PERMITTED in rental guesthouse under any conditions. We have tried allowing pets in the past but a few irresponsible guests have made it bad for everyone. In addition, many of our guests have severe allergies to certain animals. Violation of the pet policy will result in the forfeiture of the security deposit.

SERVICE DOGS
In late August 2011, we received our first inquiry concerning service dogs. We researched the legal requirement Sept 5, 2011, and accordingly we have amended our policies here on Sept 6, 2011. Service dogs are not considered pets, legally. To comply with the ADA law, we will allow service dogs. However, we will require satisfactory proof, such as a training certificate, before taking the reservation.

The guesthouse is NOT WHEELCHAIR ACCESSIBLE. There are stairs to the bedrooms and stairs to the front door. If these physical restrictions make it impractical for you, then please cancel immediately otherwise you have accepted the access limitations of the guesthouse AS IS.

ALL RENTALS ARE TO FAMILIES AND RESPONSIBLE ADULTS ONLY. You must be at least 25 years old. No high school, college or civic groups, chaperoned or not, are permitted. Properties are patrolled on a regular basis. Guest acknowledges that he/she will personally occupy the property for the entire lease period and will not sublet any portion of the property. Occupancy is restricted to the maximum occupancy as set forth in this lease. Guest agrees that the premises shall not be used for any illegal, unlawful, or commercial purpose. Moreover, use of illegal drugs, possession of firearms, or possession/storage of any hazardous substance are strictly prohibited with zero tolerance. Please use the premises and common areas in such a fashion that does not disturb or offend other guests or residents. We wish you to have an enjoyable vacation, but you must respect the rights of other guests. Violation of any of these terms and conditions shall result in termination and eviction.

SECURITY DEPOSIT A security deposit is required. We no longer accept personal checks. When making the reservation for the vacation rental, you authorize us to charge your credit card the security deposit. The security deposit amount is posted on our RATES webpage, in your quotation, and in your statement of account. When the balance of your payment is made, 30 days before the check in date or immediately if the reservation is within 30 days of the check in date, your credit card will be charged for the security deposit in addition to the amount of the rental quotation. After you check out, the premises are inspected by our inspection service. Your security deposit minus an inspection fee and minus any damage or loss amounts will be credited to your credit card account, or a check mailed to you, within 10 days of the check out date or the date at which we obtain a repair or loss estimate, whichever is later. An itemized statement outlining all associated costs will be sent via regular mail to the mailing address submitted by the Guest(s)/Cardholder(s) at such time as the reservation was booked. You further agree that the report of the inspector of the violation of the non-smoking and/or pet policy will result in 100% forfeiture of the security deposit as liquidated damages. We reserve the right to all other legal remedies for loss or damages exceeding the security deposit amount. If you cancel your reservation after we have collected your security deposit, we will refund your security deposit minus a 5 percent processing fee within 10 days of cancellation.

PAYMENT An advance payment equal to 25% or $100 USD (whichever is greater) is required immediately. This is a reservation deposit – YOUR RESERVATION IS NOT CONFIRMED UNTIL RESERVATION DEPOSIT IS RECEIVED. The balance is due 30 days before the check in date. Please make payments in the form of Visa or MasterCard. This advance payment is not a security deposit. Short Notice Reservations: If you reserve the guesthouse less than 30 days in advance of arrival, then 100% of all rents, fees, taxes and deposits are due immediately.

CANCELLATIONS - Written notice (email also constitutes written notice however you must have an email delivery receipt) is required for cancellation. (1) Cancellations made prior to 31 days before check in: The 25% advance payment or $100 (whichever is greater) is forfeit. (2) Cancellations made within 30 days of check in: 50% of the total rents and fees is forfeit. (3) Shortened Stay before check in: Changes that result in a shortened stay will incur the forfeiture of 50% of the Rents applicable to the cancelled nights (for example: shorten stay by 1 night, then 50% of 1 night’s rent and related fees is forfeit). Shortened stays may void discounts given that are based upon length of stay. This means that our standard listed rates will apply and you may forfeit more than 50% of the rents for the nights cancelled. When possible and at Lessors sole discretion, forfeited rents may be applied to a future rental. Amounts collected for taxes, applicable to cancelled nights rents, and final cleaning, if the entire stay is cancelled, will be refunded. (4) Shortened Stay after check in: No refund. Early departure does not warrant any refund of rents, service fees, cleaning fees, taxes or deposits. Notice: For stays of one week or longer, we highly recommend that you purchase vacation cancellation insurance available from most travel insurers.

MONTHLY RESERVATION CANCELLATIONS - Monthly guests must cancel one hundred twenty (120) days prior to check-in. Monthly guests who make a change that results in a shortened stay must give at least ninety (90) days written notice prior to check-in. Forfeiture rules apply, as above.

PAY PER VIEW - CABLE TV - Some units provide access to pay-per-view movies and pay per view events. You may access this feature, but you will be charged for any pay-per-view movies or pay-per-view events. These charges are in addition to rents and fees quoted. Orders made by accident or by children may not be refused. Please supervise access to this feature. If the feature is used, you will be charged for the pay-per-view movies or events plus 1 dollar transaction fee for each movie or event.

MAXIMUM OCCUPANCY- Please use common sense. Too many people may create unsafe conditions and/or the potential for damage to the townhouse. Please, no wild parties.

THIS PROPERTY REQUIRES MINIMUM STAY by season. Longer minimum stays may be required during holiday periods. If a rental is taken for less than the minimum, the guest may be charged rents equal to the minimum unless waived at the sole discretion of Lessor.

NO DAILY MAID SERVICE While the guesthouse will be provided clean upon arrival and ready for occupancy (and linens and bath towels are included in the guesthouse), daily maid service is not included in the rental rate. However additional, pre-arranged maid service is available for an additional fee. We suggest you bring beach towels. We do not permit towels or linens to be taken from the guesthouse.

RATE CHANGES Prior to confirmation, rates and fees are subject to change without notice. After confirmation, confirmed rates are in force regardless of whether rates increase or decrease. For example, Lessor may temporarily reduce rates as a special offer in order to fill unreserved nights. The decreased rates will not apply to prior rental commitments.

FALSIFIED RESERVATIONS - Any reservation obtained under false pretenses will be subject to forfeiture of all payments and the party will not be permitted to check-in. Lessee grants Lessor, their agents and the resort management the right to verify Lessees age and to inspect the premises without notice.

WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance. Emails delivered to Lessor shall be deemed to constitute written notice.

PARKING is free of charge. However, it is the guests’ responsibility to obtain permission for oversize vehicles, boats trailers, etc. from the resort management. Actions of resort management such as towing are not Lessor’s responsibility.

INDEMNITY The Guest agrees to release and indemnify the Owner from and against all liability, should anyone be injured upon the premises during the term of the lease, resulting from any cause whatsoever, except in the case of personal injury caused by the gross negligent act of the Lessor.

LOST, STOLEN OR ABANDONED ARTICLES. Neither Agent nor Lessor shall have any responsibility for lost, stolen or abandoned items. There will be a $25.00 handling fee plus shipping fees for any returned items. Lessor may deduct these fees from deposits.

LOCKED AREAS for which Guest is not provided a key or combination, such as owner’s personal storage areas, are exempt from this lease agreement and are off limits to the Guest. Forced entry into these areas is cause for immediate termination and Guest will be charged or billed for damage and/or missing items.

ACTS OF GOD AND UNPLEASANT THINGS BEYOND OUR CONTROL We sincerely want you to have a good time. However, we cannot guarantee it. No refunds or reimbursement will be given for things beyond our control. We have no control over such things as the weather, electrical outages, mechanical failures, resort facility closures, actions/inactions by resort management, the behavior of other resort guests, wildlife, pets, and any other unpleasant occurrences that may cause you a loss of enjoyment.
